All orders are recorded in the order in which they are accepted and allocated according to available stock and current delivery possibilities, without any other commitment on our part regarding delivery times. Cases of force majeure (war, general or partial strike or lock-out, epidemic, operating accidents, fire, shortage of labor or raw materials, etc.) release the sellers from any liability with regard to the performance of their obligations.
We reserve the right to request advance payments or guarantees from our customers at any time.
No goods or supplies will be taken back unless expressly agreed in writing, and only insofar as they are returned to us carriage paid and undamaged.
In the event of death, bankruptcy, incapacity, suspension of payment, dissolution or modification of the company, failure to pay for a single delivery, or non-compliance with special payment conditions, we reserve the right either to terminate the contract or to suspend delivery and, in any case, to demand immediate payment of all goods delivered. We also reserve the right, in all the above-mentioned cases, to demand the return of our goods where applicable.
To be admissible, all complaints must be submitted by registered letter within eight days following the delivery of goods, services, or other. After this period, no favorable action will be taken on any complaints.
All our invoices are payable in cash.
For each month of delay, any unpaid invoice shall, by operation of law and without prior notice of default, bear interest at the discount rate of the National Bank increased by 3%. Furthermore, in the event of unjustified non-payment at the due date, the invoice shall, by operation of law and without prior notice of default, be increased by a fixed compensation of 15%, with a minimum of €75. In the event of a dispute, only the courts of Liège, Verviers division, shall have jurisdiction.
The seller remains the owner of all goods delivered, including with regard to third parties, until full payment of the price has been made. During this period, the buyer bears the risk of destruction or deterioration of the goods and undertakes not to sell, transfer, or pledge the goods. Any disputes or legal recovery actions shall fall exclusively under the jurisdiction of the Justice of the Peace Courts or the Commercial Courts of Liège, Verviers division.
